Default Marleys Wholesale/n1 dropshipper

Ordered 100 8gb MP4 nano style from these people.

Had 18 delivered from 'UK stock'

Sold them very quickly on ebay - Had 5 returns already for a multitude of problems!!!

Told need to send them back to China as even though i bought from his site he is not liable for refunds/replacements as he is only effectively an agent for the website owner working on commission.

I am awaiting a further 80+ players in the next few days, do not wish to take the risk of selling anymore of them. I want to send them to Marleys in Devon for a refund without even opening the shipment. I suspect he will try to say he canno/will not do this

The guy is a nightmare to deal with.

Any advice anyone, as we are well out of pocket! And really mad

am i right in thinking that under distance selling regulations i have 7 days to return the goods unused, when i receive them, for a full refund?

I would suggest a quick phone call to trading standards tomorrow morning, and find out where you stand! I would also guess that he will come on here, and tell you it will all be ok, and if any of us say anything about his company tht is untrue he will see us in court (that is his normal defence!).

Yes 7 days unused - then a full refund - but he may claim that you need to return them to china - don't even if they get there they will claim that havn't!

Also maybe look at speaking to Devon and Cornwall Police about his company - tnhey may wish to have a word and as I used to work for D&C Police I can let you know that they have a department just setup to deal with internet scam and law breaking companies.

Let us know how you get on, I expect you will be promised the earth, but it wont be delivered - and becuase I dont want manleys taking me to court!!!!! Take all the above as "what I belive to be true" and as such may not be the truth!

Sent them recorded - and signed (insured) for directly to his Devon location - maybe put in a claim on your credit card against him. If he still wont play ball, then maybe this could be a good case for Watchdog?

With regards to him being the middleman, was this explained to you at point of sale, or within his terms and conditions of sale? If things "suddenly" change on the website - do a serch for old internet as there is a chache of all internet pages and you will be able to see if terms have been changed after I placed this online.
