Need advice regarding a buyers request for a refund. Please Help!!!!

I placed an advert for a copy of Adobe CS3 Photoshop on eBid. On this listing I stated that I would provide a 7 day return policy if products were unopened. Through this listing I was put in contact with a buyer who outside of eBid and only using PayPal arranged to buy 13 copies of the aforementioned CS3 Photoshop. The buyer now has requested a refund.

I believe as the purchase was made outside of eBid and eBid did not use any of its facilities to facility the transaction, that the 7 day returns policy no longer applies to this deal. During the communications to arrange the deal I did not in any way propose that the deal taking place was not in any way affiliated or similar to the deal proposed on eBid nor did I mention or propose a return policy of any kind. Taking this into consideration I believe that I am not required to provide a refund for this sale.

However I would like your advice as to whether I am in the right or if I am indeed required to send a refund.

Why does he want a refund?

If you're selling to consumers they have a 7 day cooling off period by law.

EDIT (I missed ot the second sentence!)

But obviously 13 copies for re-sale isn't going to be a consumer purchase.

13 copies of CS3 Photoshop??? We are talking about thousands of pounds here...

I wouldn't get involved in first place (because he could easily scam you with PayPal) - anyway - If he sends back all the copies and they're un-opened just refund less postage you paid.

Problem is Iv already spent the money I was never intending on giving a refund. His execuse for a refund was that he was selling them to a client and the deal fell through. This leads me to belive that he is a business and if so this deal would be a business to business sale which is not covered in the Distance Selling Regulations.

Also the sale was for £585 not thousands.

Agreed! Just checked the price and it's about £585 for 1 not 13!

They were not counterfit AT ALL. They were fully legit CS3 editions with an unusued license key, a COA and an unopneded sealed box.

How could he scam me with paypal?

Where did you get 13CS3 for £585? (or to make a profit - for less than that)

I would rather not revele my sources. However I am stilll unsure as to what to do. I cant give a refund as I simply do not have the money, but I do believe I do not have to give a refund. If im forced to give a refund by paypal im officially screwed.
