Buyer claims item isnt as described?
Hi everyone,
Recently sold a faulty XBOX console which I clearly labelled and described as faulty.
I also stated no controllers, HDD or leads were being supplied.
I also stated there were scuffs on the back, but I myself had not tampered with the console (I also stated it was being sold on behalf of a friend)
Whats more, the buyers paypal address was unconfirmed, and took THEM a week to respond to my two emails stating that I only wanted to confirm their address before I send out a high value item.
This is there email to me today:
"you took 8 days to send this thing to me, you are a liar you didn't say it had been opened, you didn't send the controls and cables so I will send it back to you straight way. Please do not CLAIM YOUR PAYMENT as I am going to take it back by contacting EBAY and PAYPAL."
What position am I in here, and whats my best plan of action?
Should I contact eBay, if so, how do I do this?

Recently for me, eBay has proved more of a hassle than anything!
If they decide to take the buyers side then I'll seriously consider some sort of action against both the buyer and ebay as this has seriously ticked me off.

Three things can happen;
-If he's paid by credit card then he can make a chargeback, and there's little you can do about that. However you may be protected by paypal under if this is the case. I only mention is as I think its possible he could still do this after making (and losing) a paypal claim
-He can claim through paypal either as not arrived or not as described. As far as I know he has to prove its not as described to win but if he's claiming he's not received the item then you have to prove delivery. By the way only a recorded delivery method will prove delivery, plus a signature is needed if it was over £150.
-Also ebay now are testing their own claim method on some paypal claims, however it appears this is purely a paypal claim. Ebay say they will operate the same as paypal would do so the above information is also usually if ebay are handling this.
By the way did you sell as a business and was it a BIN?
Hope that helps. Ebay can get very annoying, I've had a numbers of customer complain as they either didn't read or didn't care about the listing. I'm the same and clearly state what the item is like honestly and fairly, but some people just don't read it.

It was sent recorded delivery, after a week of trying to get his address!
He claims it wasnt as described, but I clearly stated in EVERY WAY possible the faults and blemishes on the consoles to the best of my ability.
He then claimed I failed to send controllers or leads - when both were mentioned as NOT INCLUDED.
I have stated this on the Paypal dispute.
Was wondering if anyone knew which email address to contact Paypal with in regards to something like this?

I'd just ring paypal, they've always been better to deal with on the phone than via email for me at least.
Also did you sell the item as a business and as BIN? As if you did, you'd legally you would have to comply with DSRs, and accept returns under certain time frames.

It was a regular auction as I didnt mind how much I got for it because it was just taking up space and collecting dust - and I had replaced the XBOX console months ago.
I'll give them a ring tomorrow, hopefully wont be put on hold for too long as it seems like its going to be a loooong day for me tomorrow.

Thats good, the DSRs can be hard on sellers, but since its an auction at least you don't have to worry about that.
