if anyone is thinking of selling these on Amazon, forget it, it seems that they are pulling all listings down, today I received the following email:

they've been plling them for around a month now.

To be honest I'm pleased they've been killing the price for sometime now.

I think that the only thing they can do is pull the listings, it is unlikely legal action will be taken, as the case for Homebrew software is going to be hard to fight, along with thee fact that you can buy blank DVDs and cds etc.
Only thing is the prices will either tumble as people will want to get shut of large stock - or the price will go up and the R4DS will go underground.

these letters are nothing new. Amazon used to sell the M3 themselves last year and got a letter from Elspa the same then.

ELSPA have been issuing these letters for over 12 months. At this point in time they are still fully legal product. It is currently under review and possibly a ruling will be made. At that point we will top dealing in them but until then we'll keep selling them.

Simply Games are one of the reasons behind this. Simply Games were selling the R4 along with others then they made a press release After consultation with Nintendo we have decided to no longer sell the R4 due to piracy blah blah. Which roughly translated meant that Nintendo were going to pull the plug on them. So Simply Games are now leading the fight to stop the sale of the R4 and similar (wonder how much they made though?) and Amazon was going to be contacted as they were one of the biggest market places for them.
Nintendo have not really complained too much about these in the past as there is no denying that they have helped hardware sales but now they are clamping down. There is now a call with Indies in the UK for all sales to be stopped.
If Amazon do pull them all then it could mean a price increase especially if sites in the UK are also stopping them.....but doubt all will
