Default Australian Import Rules?

Hello, i am thinking about importing Phones yeh, nokia ext and reslling them here

But apparently thats illegall and i cnat do it? how are all these people on ebay doing it ext

Is it just the law here or everywhere the same?

A few months back i found a very good supplier of authentic gucci ext but contacted customs and they said its illegall all this trademark things.. Soo pretty much anything that has a name i cant import / sell? Like nothing?

How are all these people doing it? is it the same everywhere or just Australia has these tight rules

I dont know i'm really upset as i spent all my time findign a good legit Phone supplier only to find out It will get seized..

Thank you for your enquiry.

You need to strongly research into trademark issues.

Parallel importation is the importation of genuine (non-counterfeit) goods outside of the distribution network of the trade mark owner. Customs will only seize genuine goods if the trade mark has been applied without the consent of the Australian trade mark owner. Before importing goods which bear trade marks it is important to establish who the registered owner of the trade mark is in Australia. If the trade mark was not applied to the goods by, or with the consent of, the Australian registered owner of the trade mark, importation of those goods may infringe the registered trade mark and may be seized by Customs. This is a complex area of intellectual property enforcement.
It is very important that you firstly check that a Copyright or a Trade Mark has not been applied to the goods which you intend to import. There may be a registered Trade Mark or Copyright owner who has lodged a Notice of Objection in place with Customs to protect their goods from importations of counterfeit or unauthorised goods entering Australia. A notice of objection will allow Customs to seize goods that infringe upon the trade mark/copyright owner's rights.
To check if the goods you intend to import are protected by a Trade Mark or Copyright with Customs please view our website www.customs.gov.au <http://www.customs.gov.au> /Media publication and forms/Customs notices/Intellectual property-notices of objection.
To check if the goods you intend to import are protected by Trade Mark or Copyright applied in the domestic market to your goods, please view the IP Australia website at www.ipaustralia.gov.au
If the brands are a registered trademark and they are being sold in the market place, then the registered trade mark owner has the authority to
* Take legal action out against the seller and also
* If the goods have been sold take further infringement action
Customs will not seize the goods on importation if there is no notice of objection on the goods however from a legal perspective it would not be a wise decision.


If a notice of objection is in place for these goods and you are still considering importing them, it is important that you understand your legal position. You might wish to obtain legal advice to assist you.

The way I understand what the Australian Customs are saying is that you cannot bring an item into Australia if it has a trade mark registered in Australia without the owners consent. This would imply that if it is not registed in Australia you can bring it in. May be worth further investigation.

Yeh, thing is just about everything is registered.. Nokia, Gucci, Dior, ( any brand you can think of ) Soo how do all these people sell on ebay ext..

Alright thanks for the info, I reckon thats tight as, are all countries the same? Or only AUS

So all the sellers on Ebay are registered with AUS wholesalers? Doubt it?

I just spoke with customs, and the guy says you can bring them in if there Real but you cant sell them, as "Intelectual Rights" or something, He said you need to contact nokia and get a licence to sell them...Yeh as if nokia are gonna let anyone get a licence.

So i asked him about all the sellers on ebay? There are thousands selling everyday and he said he doesnt know..

So i ask him later that getting them into the country is no problem and he said no, and said nokia has the rights. or something.

Wats up with this, i found a really good supplier after all this hard work only to find out 1. I cant import them 2. I cant sell them..

Is it the same in the US other countries?

Ok now i'm confused.. That wholesale site you gave me, If i get registred with them and get phones off them? am i allowed to sell them? I stil dont have Nokia's permission..
Ahh confusing. I think if i import the phones they will come in fine and i will sell them no problems.. I mean a few months back i was Unknowingly importing Shoes (nike ext ) 12 pairs at a time every few week, and it always came through, Once it even had the sticker on it saying Inspected by Customs.. and came through? I'm pretty sure nike / puma are registered ext.. And then i realized they were Fake shoes and stopped doing it when i got a letter form puma..,, dont want to do nothing illegall. so obviously stopped doing it?

Customs opened inspected it, and puma knew i was reselling there shoes ( to make things worse FAKE ) and they just warned me to stop doing it,, i'm pretty sure if the shoes were Real i would have been fine?

Sooo I'm guessing i should be fine? Any thoughts

You need to deal with the authorized distributors for each brand name you want to sell.Brightpoint is an authorized distributor for Nokia.Once you have an account setup with Brightpoint,you are authorized reseller!

Nike and Puma sell direct to retail stores,there`s no authorized wholesale distributor for those brands!

Every country has different customs laws,Australia has very strict laws on importing.

Alright so, can i bring the Nokia phones into the country i'm just not allowed to resell here, or not even allowed to bring them in ( they will be siezed ),, Thats jsut confusing me because i Doubt all the sellers on ebay are registerted, and there are so many? So i'm guessing you can bring the phones into the countyr?

The authorized distributors for Nokia in Australia probably have an exclusive contract from Nokia to distribute their phones in Australia.Ebay sellers could be importing from Hong Kong, which would be classed as parallel trading(Grey Market Goods) that's why they could be seized by Australia customs!
