I operate a business in Spain. I have a customer (in Spain) who wishes to buy goods off me. He tells me he has a UK registered company and is in the process of setting up a business in Spain. He has asked for the invoice to be made out to his UK business but without IVA (Spanish VAT). I am not sure if this is legal and where I stand regarding the VAT/IVA issue.
You're in spain - he's in spain. That's all you need to know. You will need to add VAT to the order. It doesn't matter where the invoice goes - it matters where the parcel goes. I could rent an office in spain and send all of my invoices their if it meant I didn't have to pay VAT - not that easy I'm afraid.
