How long was it since they entered the country?

There are new rules, unless you receive a court summons within 30 days of the goods entering the country they can't do anything.

But if HMRC send you the goods I would get rid of them immediately.

As the above info shows, they arrived at Heathrow on 2 Oct does that mean the date has passed for a court summons, please help this is all too confusing for me. The letter from the solicitors states I should reply within 7 working days otherwise Deckers will take appropriate actions which may result in me being served with a court summons

If you sign the declaration form, you may end up facing a civil suit for damages. You need professional legal advice!

Once you sign the declaration form you have admitted guilt,do not sign any documents without talking to a lawyer.

This is what I would do, but i'm no means an expert in this field. So it's up to you if you want to take legal advice.

I would wait until 10th November. If you don't receive a legal summons or the goods by then I would ring HMRC and demand that they release the goods to you under European Council Regulations as you have not received any summons.

Once the goods were received I would take them straight down to the local recycling centre and get rid of them. Without them being able to seize the goods as proof, and without being able to prove that you bought them with the intention to sell them, it is highly unlikely they would win any court case. So I doubt they would bother.
